Preservation and Avoiding Practice Pitfalls Under the New Federal Rules of Civil Procedure

On December 1, 2015, the new amendments to the Federal Rules of Civil Procedure went into effect. The 2015 amendments address the challenges of data preservation with a new Rule 37(e), which significantly changes court’s analysis regarding duties of preservation and the standard for spoliation.
